Terms and Conditions
1. registration/entry
To be eligible for the prize draw, you must have shared at least 1 post in response to our “Your Christmas Gaming Story” challenge. Post your gaming story on Instagram and/or Facebook by 12/19/2024, link to us in the post and tell us how gaming enriched your Christmas.
2. eligible participants
The competition is open to anyone who has properly completed all necessary eligibility requirements. Employees, agents, successors and assigns are excluded.
3. other terms and conditions
Participation is only possible via Facebook or Instagram. Participation is in no way linked to the purchase of Funtails products. By entering the competition, participants agree to be bound by these rules. Participation is possible within the time limits specified in the competition.
4. Determination of the winner & period of participation
The winner will be drawn from all participants who have linked Funtails in a post explaining how games enrich their Christmas celebrations by 24.12.2024. The winner will be notified via Messenger on Instagram or Facebook and will have 48 hours to activate the prize.
5. Prize
The prize for this contest is a surprise package of 3 of our games. Only one prize per person. The prize cannot be transferred or redeemed at another time. The prize cannot be exchanged for cash.
6. Winner notification
The winner will be notified via Messenger.
7. Applicable law
The competition is exclusively subject to German law.
8. shipping of prizes
The prizes will be sent to the address of the winner. For this purpose, the participant must agree to provide the organizer with a delivery address. If the winner does not respond within 48 hours of notification, he/she will forfeit any claim to the prize.
9 Termination
Funtails reserves the right to cancel or terminate the competition at any time without prior notice. This is particularly the case if the competition cannot be carried out as planned for any reason, such as errors in the software and/or hardware and/or other technical and/or legal reasons that affect the administration, security, integrity and/or the regular and proper execution of the competition. In such cases, Funtails also has the right to modify the competition at its own discretion.
10. data protection
The personal data collected and processed by us is primarily used for the purposes of running the competitions and, with the participant’s consent, for sending the prize. In doing so, we observe all applicable data protection laws that are valid for Germany.
11. Legal recourse and liability
Legal recourse is excluded. There is no enforceable claim to the payment of prizes. Funtails is not liable for the loss, delay, alteration, manipulation and/or misdirection of e-mails and/or data during data entry, collection, transmission and/or storage caused by external data networks, in particular the Internet or the WWW, external telephone lines and/or other hardware and/or software of the participants and/or third parties; this also applies in particular to incorrect, missing, interrupted, deleted or defective data. Funtails is also not liable for incorrect information caused by participants and/or third parties, their hardware and/or software and which is used for or in connection with the competition. Furthermore, Funtails is not liable for the theft or destruction of the systems and/or storage media storing the data or for the unauthorized modification and/or manipulation of the data in the systems and/or on the storage media by the participants or third parties. Otherwise, Funtails is only liable for gross negligence or intentional acts of its legal representatives, employees or vicarious agents. Furthermore, Funtails is not liable for damages incurred by the winner or relatives of the winner in connection with the prize. The above exclusion of liability does not apply if liability is mandatory, e.g. in cases of intent, gross negligence, injury to life, limb or health or breach of material contractual obligations. However, the claim for damages for the breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless liability is assumed for intent or gross negligence or due to injury to life, limb or health. A change in the burden of proof to the detriment of the participant is not associated with the above provisions.
12. severability clause
If any provision of these terms and conditions is or becomes invalid, the validity of the remaining provisions shall not be affected. In such a case, the organizer and the participants are obliged to cooperate in order to create provisions that come as close as possible to the economic result of the invalid provision.
